Michael Roman’s lawyers have taken an unusual legal tack against Fulton County DA Fani Willis over Nathan Wade being appointed as the prosecutor in their Georgia case involving President Trump. They assert, without evidence to back their allegations, that this may have been done improperly and have accused her of improperly hiring Nathan Wade as prosecutor without consulting them first.

Wade and Willis had an improper relationship that created an “irreconcilable conflict of interest,” the filing states, suggesting the case should be moved from state court to federal.

Defendant’s Legal Team Files Motion to Disqualify Fulton DA

Fulton County District Attorney Fani Willis of Georgia overseeing Donald Trump’s federal election interference case has been accused of having an inappropriate romantic relationship with one of its top investigators on the investigation, according to one defendant in the case. Another co-defendant filed a motion asking her disqualification as prosecutor because this could compromise its integrity and compromise future prosecution efforts against former President.

Trump stands accused of violating Georgia’s anti-racketeering law and conspiring to interfere with its election process, according to Georgia authorities. They accuse former president and 18 others of initiating an illegal criminal enterprise to alter the outcome of 2016 presidential election in Georgia’s battleground state; as well as 41 criminal counts that include election interference charges which carry severe prison time penalties against Trump.

In this case, Georgia’s former president stands accused of conspiring to violate RICO laws as well as several felony counts related to his efforts at overthrowing election results illegally. His attorneys contend that their client was exercising their right to free speech and that any of their actions do not constitute illegal election interference.

Prosecutors for some of the other defendants in the case have, however, indicated that Trump’s actions are unlawful and should be punished accordingly. They claim there is evidence proving his interference in other states’ election processes as well as illegal coordination between his campaign and those working to cheat the system.

Despite these allegations, a judge decided that Willis would be suitable to prosecute Trump and the other defendants in their lawsuit. She cited several court cases which determined that relationships between an assistant district attorney and witness are legal as long as there is no proof that their conduct was illegal or corrupt.

Willis as being “transparent”?

Many who have worked with Willis over time describe her as an aggressive, dedicated, and hardworking prosecutor who takes her job seriously. Brian Steel, one of her long-term colleagues who is a defense attorney himself, describes Willis as being “transparent” while remaining “zealous in representing Georgia”.

Willis has worked on numerous high profile murder trials during the last decade. She was also responsible for investigating corruption and fraud at Atlanta public schools, such as teachers falsifying test scores. Willis points out that her approach to investigating corruption and fraud at these schools provides an indication of her approach towards Trump case.

Willis was elected in 2021, defeating six-term Republican Paul Howard and inheriting an extensive backlog of cases. She campaigned on a pledge to restore integrity to her office and quickly began sending letters urging Georgia officials to preserve documents potentially related to election interference. On Thursday, House Judiciary Committee Chairman Jim Jordan (a Republican from Ohio) demanded information on Willis’ involvement with the Trump investigation, such as coordination between her work and communication between government offices or members of federal executive branches.
